1. Introduction
These Terms and Conditions ("Terms") set out the basis on which Hartleys Professional Tree Surgeons Ltd provides services to customers. By requesting a quote or engaging our services you agree to these Terms.
2. Quotations and acceptance
Quotes are valid for the period stated on the quote (or 30 days if no period is specified). A contract is formed when you accept a written quote or we confirm a booking in writing.
3. Price and payment
Our quoted price is based on the information available at the time. Additional work or unforeseen issues (e.g., hidden rot, restricted access, discovery of protected species) may incur extra charges. Payment terms will be specified on the quote or invoice. Unless otherwise agreed, payment is due within 14 days of invoice date.
4. Deposits and cancellations
Where a deposit is required to secure a booking this will be stated on the quote. If you cancel a booked appointment without reasonable notice (typically less than 48 hours) we reserve the right to retain the deposit or charge a cancellation fee to cover lost costs.
5. Access and site conditions
You must provide safe and legal access to the site. We will not proceed if the site is unsafe or access is not provided. Any delays caused by site conditions may lead to additional charges.
6. Health & safety
We operate under relevant health and safety legislation. You must inform us of any hazards or underground services before work starts. We will take reasonable steps to protect property, but some risk of damage is inherent in tree work; we will advise on potential risks and agreed mitigation.
7. Subcontracting
We may subcontract parts of the work to reputable contractors; we remain responsible for the overall delivery of the contracted services.
8. Photographs and site records
We may take photographs for records and quality assurance. With your consent we may use images for marketing; you may withdraw consent at any time.
9. Liability
We accept liability for direct loss caused by our negligence up to the limit of our insurance cover. We are not liable for indirect or consequential losses (such as loss of income). Our liability does not extend to pre-existing defects, or damage caused by factors outside our control.

11. Data protection
We will handle your personal data in accordance with our Privacy Policy.
12. Intellectual property
All intellectual property rights in materials we produce (quotes, reports, drawings) remain our property unless otherwise agreed in writing.
13. Governing law
These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the English courts.
